Accounts

When you complete the registration process by providing information as prompted on the registration page, or when you use other products in a manner permitted by IPFLY, you are bound by these Terms of Service. You may use the email address you provided or confirmed, or other methods permitted by IPFLY, to log in to the website.

When creating an account, you must always provide accurate, complete, and up-to-date information. Failure to do so constitutes a breach of these terms and may result in the immediate termination of your account on our services.

You are responsible for safeguarding your password and any activity or actions under your account, whether your password is used for our services or third-party social media services.

You agree not to disclose your password to any third party. You must notify us immediately if you discover any unauthorized use of your account or any breach of security.

You may not use the name of another person or entity, unauthorized names, trademarks, or any name subject to the rights of others, or any offensive, vulgar, or obscene content as a username.

If you violate national or local laws, regulations, or the Terms of Service, IPFLY reserves the right to suspend or terminate provision of part or all of the services until your IPFLY account is deactivated.

Refund Policy

At IPFLY, we strive to provide consistent and sustainable services. If IPFLY services require you to provide your bank account information, we will strictly adhere to confidentiality agreements once such information is provided.

Any disputes arising from customer access to or use of the system shall be resolved as follows:

Dispute Resolution Procedure

Any disputes arising from the use of the system should be directed to IPFLY support via email at support@ipfly.net, and we will address any refund-related inquiries.

For security reasons, we record customer interactions with support. Payments for services not related to product functionality are non-refundable. All payments are final. If you encounter product issues, we are available to assist you at any time.

Content

Your Rights to Post Content

Our services allow you to post content. You are responsible for the content you post to IPFLY services, including its legality, reliability, and appropriateness.

By posting content to IPFLY services, you grant us the rights and license to use, modify, publicly perform, publicly display, reproduce, and distribute such content on and through IPFLY services. You retain all rights to any content you submit, post, or display on or through IPFLY services, and you are responsible for maintaining these rights. You agree that this license includes the right for other users of IPFLY services to access your content under these terms.

You represent and warrant that: (i) you own the content or have the right to use it and grant the rights and licenses set forth herein, and (ii) your content does not infringe on anyone's privacy, publicity, copyright, contractual, or other rights.

Content Restrictions

IPFLY is not responsible for user content. You understand and agree that you are solely responsible for all content and activity under your account, whether by you or any third party using your account.

You may not transmit content that is illegal, offensive, disturbing, hateful, threatening, defamatory, obscene, or otherwise objectionable. Examples include but are not limited to:

● Illegal or promoting illegal activities;

● Defamatory, discriminatory, or malicious content, including references to religion, race, sexual orientation, gender, ethnicity, or other protected groups;

● Machine or randomly generated spam, unsolicited advertising, chain letters, or any form of unauthorized solicitation, lottery, or gambling;

● Viruses, worms, malware, trojans, or other content intended to damage, disrupt, or limit functionality of software, hardware, or telecom devices, or unauthorized access to data or third-party information;

● Infringement of any proprietary rights, including patents, trademarks, trade secrets, copyrights, publicity, or other rights;

● Impersonation of any person or entity, including IPFLY and its employees or representatives;

● Infringement of third-party privacy;

● False information or misrepresentation.

IPFLY reserves the right, at its sole discretion, to determine the appropriateness of content, refuse or remove content (without obligation), and to format, edit, or modify content. Posting objectionable content may result in restricted or revoked access to IPFLY services. Since IPFLY cannot control all content posted by users or third parties, you agree to use IPFLY services at your own risk. You acknowledge that you may encounter offensive, indecent, inaccurate, or objectionable content, and you agree that IPFLY is not liable for any content, errors, omissions, or damages resulting from your use of any content.

Content Backup

Although content backups are performed regularly, IPFLY does not guarantee that data will not be lost or corrupted.

Damaged or invalid backup points may result from content corrupted prior to backup or modified during backup.

IPFLY will provide support to address known or discovered issues affecting content backups. However, you acknowledge that IPFLY is not responsible for the integrity of content or failure to successfully restore content.

You agree to maintain a complete and accurate copy of your content independent of IPFLY services.

Copyright Policy

Intellectual Property Infringement

We respect the intellectual property rights of others. Our policy is to respond to claims of copyright or other IP infringement on IPFLY services.

If you are the copyright owner or an authorized representative and believe that a copyrighted work has been copied in a way constituting infringement, you must submit a written notice to our copyright agent via email (support@ipfly.net) including detailed information on the alleged infringement.

Misrepresentation of infringement claims may result in liability for damages, including fees and attorney costs.

Intellectual Property

IPFLY services and their original content (excluding content provided by you or other users), features, and functionality are proprietary to IPFLY and its licensors.

IPFLY services are protected by domestic and international copyright, trademark, and other laws.

Our trademarks and trade dress may not be used with any product or service without prior written consent from IPFLY.

Feedback

You transfer all rights, title, and interest in any feedback you provide to IPFLY. If such transfer is invalid, you grant IPFLY a non-exclusive, perpetual, irrevocable, royalty-free, worldwide license to use, copy, disclose, sublicense, distribute, modify, and exploit such feedback without restriction.

Our services may contain links to third-party websites or services not owned or controlled by IPFLY.

IPFLY is not responsible for the content, privacy policies, or practices of any third-party websites or services. You acknowledge that IPFLY is not liable for any damage or loss caused by or alleged to be caused by the use of or reliance on any such content, goods, or services.

Termination

We may terminate or suspend your account immediately, for any reason (including violation of these Terms), without notice or liability.

Upon termination, your right to use IPFLY services ends immediately. To terminate your account voluntarily, simply stop using IPFLY services.

Limitation of Liability

Notwithstanding any damages you may incur, IPFLY and its suppliers' total liability under these terms and your sole remedy is limited to the amount you actually paid for IPFLY services.

To the maximum extent permitted by law, IPFLY and its suppliers are not liable for any special, incidental, indirect, or consequential damages, including lost profits, data loss, or other losses arising from or related to the use or inability to use IPFLY services, third-party software or hardware, or other causes, even if advised of the possibility.

Certain jurisdictions do not allow exclusion of implied warranties or incidental or indirect damages, so some limitations above may not apply.

"As Is" and "As Available" Disclaimer

IPFLY services are provided "as is" and "as available," with all faults and defects, without any warranties. To the fullest extent permitted by law, IPFLY, its affiliates, licensors, and service providers disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, title, non-infringement, and warranties arising from course of dealing or usage.

IPFLY does not warrant that services will meet your requirements, achieve expected results, be compatible with other software, applications, systems, or services, operate without interruption or error, or that any errors will be corrected.

Certain jurisdictions may not allow limitation of consumer rights, so some exclusions or limitations may not apply to you.

Governing Law

These Terms and your use of IPFLY services are governed by the laws of your country/region (excluding conflict-of-law rules). Use may also be subject to other local, state, national, or international laws.

Dispute Resolution

For any concerns or disputes regarding IPFLY services, you agree to first attempt informal resolution by contacting IPFLY.

Disclaimer

Under no circumstances shall IPFLY be liable for any consequential, special, incidental, or punitive damages, or for any loss of profits or revenue, under any theory of liability, even if advised of the possibility. Cumulative liability is limited to fees actually paid by the customer in the month prior to the event.

Policy Updates

IPFLY may modify these terms in accordance with applicable laws. Updated terms take effect upon posting and replace prior versions. Users are responsible for reviewing the latest terms. Continued use constitutes acceptance of the updated terms. If any provision is found invalid or unenforceable, it shall be severable and not affect the validity of other provisions.
